1. What Dial Mom is
Dial Mom ("the app," "we," "us") is operated by Jesse Tolz, an individual doing business as Dial Mom. It is a general-purpose personal relationship reminder tool. You add the people you want to stay in touch with, set how often, and the app nudges you when someone is due or has a birthday coming up.
Dial Mom is not a medical-record system, legal case-management system, emergency service, or regulated professional-record system. Professionals may use it personally, but should not rely on it for regulated client or patient records, emergencies, diagnosis or treatment, legal deadlines, required retention, or other professional recordkeeping obligations.
2. Who can use it
Dial Mom is a general-audience service for people age 13 and older; it is not directed to children under 13. You represent that you are at least 13 years old (and meet any higher minimum age that applies where you live). If you use the app on behalf of an organization, you confirm you're authorized to accept these Terms for it.
3. Your account
You can use Dial Mom entirely on your device without an account. If you sign in (via email or a supported identity provider), you're responsible for keeping access to that email or account secure. You can sign out at any time. Signed-in users can initiate permanent account and synced-data deletion from Settings in the app (see the Privacy Policy).
4. Information and recordings you add
You're responsible for the people you add and any details you enter, import, store, or sync about them. By doing so, you represent that you have the rights, permissions, notices, consents, and other lawful basis required to use that information in Dial Mom. Only add information you're entitled to keep, and use it lawfully — for personal outreach, not for bulk marketing, harassment, or anything you wouldn't want done to you. Dial Mom never contacts anyone on your behalf; tapping Call or Text simply opens your phone's own dialer or messaging app.
You are also responsible for every recording you create. Recording and consent laws vary by location and situation, and some require consent from every participant. Before recording another person or a conversation, you must give any legally required notice and obtain any legally required permission. Do not create or keep a recording unless you have the lawful right to do so. Dial Mom does not determine whether consent is required or obtain consent for you.
5. Free and Pro plans
- Free includes the full core loop, is capped at 20 contacts, and includes private sync of interaction history for signed-in users when sync is on.
- Paid Founding Member lifetime is a one-time $10 non-renewing unlock. It is limited to the first 250 paid Founding Members.
- Pro is always available for $1/month or $10/year. Eligible App Store customers may receive Apple's one-month introductory free trial. If web subscriptions are later offered through Stripe, an eligible web trial may be exactly 30 days. Pro unlocks unlimited contacts, groups/tags, and private voice-note cloud backup and retrieval while the user is signed in and sync is on.
- Referral-earned Lifetime Pro is a separate, nontransferable entitlement tied to the referrer's verified sign-in identity. It is granted after five qualifying referrals and does not consume, reserve, or reduce any of the first 250 paid Founding Member spots.
For both offers, “lifetime” means for as long as the Dial Mom service continues to operate. It does not mean anyone's biological lifetime and is not a guarantee that Dial Mom will operate forever. We intend lifetime access to continue if Dial Mom is renamed or replaced by a substantially equivalent successor service. If Dial Mom is acquired, continuation may depend on the acquirer and the transaction terms; we cannot guarantee an independent acquirer's future conduct, although existing lifetime obligations should be identified in transaction documentation.
Paid Founder inventory is calculated server-side as 250 minus valid paid Founding Member lifetime entitlements. Referral-earned lifetime never affects that inventory. Before 120 spots remain, we display only that the offer is limited to the first 250 paid Founding Members. At exactly 120 remaining, we begin displaying the truthful remaining number and update it after each completed qualifying purchase. A verified refund, reversal, revocation, or otherwise invalid purchase reopens its spot. We do not use countdown timers, fake or batched scarcity, or a false deadline.
Prices are in U.S. dollars and may change; we'll give notice of changes to recurring prices before they take effect for you.
A qualifying referral must be a genuinely new person who enters through the referrer's unique link or code, creates and verifies a new Dial Mom account, adds or imports at least one contact, sets a contact cadence, returns and uses Dial Mom on a different calendar day, and passes fraud checks. The referred person does not need to start a trial or purchase anything. Self-referrals, duplicate or disposable accounts, automated activity, referral reassignment, and other manipulation do not qualify. We may place suspicious activity under review, reject or revoke a qualification before reward issuance, and revoke an issued referral reward only for documented abuse or fraud—not ordinary later inactivity or account deletion.
6. Billing, renewals, and cancellation
Auto-renewing subscriptions. Paid monthly and annual plans renew automatically at the end of each period unless you cancel at least 24 hours before it ends. When you subscribe through Apple's App Store, payment is charged to your Apple Account, and you manage or cancel the subscription in your device's Settings → your name → Subscriptions. If web subscriptions are offered, billing will be handled by Stripe and a web billing-management link will be provided.
A free trial (if offered and if you are eligible) converts to the displayed paid subscription unless you cancel before it ends. The purchase screen controls the exact trial end date and post-trial price. The one-time Founding Member unlock is not a subscription and does not renew. Except where required by law or a platform's own policy, payments are non-refundable; App Store purchases are subject to Apple's refund process.
If Dial Mom discontinues the service, paid lifetime purchases are nonrefundable except where Apple's policy or applicable law requires otherwise.
Paid Founding Member lifetime and referral-earned Lifetime Pro cannot be sold, gifted, or transferred to another person or account. After account deletion and recreation, paid Founding Member lifetime can be restored only with verified Apple purchase/restore evidence. Referral-earned lifetime can be restored only to the same verified sign-in identity. Changes involving email aliases, Sign in with Apple relay addresses, Apple Accounts, or identity-provider records may require strong additional verification and manual support review. Restoration restores the entitlement—not contacts, notes, recordings, or other deleted content.
Deleting your Dial Mom account does not cancel an App Store subscription. Cancel or manage an Apple subscription separately through your Apple Account before or after deleting Dial Mom.
If you earn referral Lifetime Pro while an Apple subscription is active, Dial Mom will show the earned status and provide access to Apple's subscription-management page. Dial Mom cannot automatically cancel or refund Apple billing. Referral Lifetime Pro remains active whether or not you immediately cancel the Apple subscription.
If Pro expires, access to cloud voice recordings and new voice uploads stops immediately, while recordings already stored locally remain available on that device. Cloud voice files and their cloud metadata are scheduled for permanent deletion 90 days after expiration. The app shows the scheduled date; if notification permission is available, it also schedules local warnings at expiration, with 30 days remaining, and with 7 days remaining. Renewing Pro during that period restores cloud access. Account deletion overrides this grace period and prompts deletion of the cloud files immediately.
7. Optional website support
Dial Mom's website may offer optional ways to leave a tip. A tip is voluntary, is not a charitable donation, and does not purchase or unlock Pro, Founding Member status, a referral qualification, preferential treatment, or any other digital feature.
8. Acceptable use
Don't: break the law with the app; try to access other users' data; reverse-engineer, scrape, or overload our systems; resell the service; or use it to store data you have no right to hold. We may suspend accounts that do these things.
9. Your content and our software
Your data (contacts, notes, voice notes, history) is yours — we don't claim ownership. You grant us only the limited permission needed to store and, for supported data when sync is on, sync it so the app works for you. The Dial Mom app, name, logo, and design are ours; these Terms don't give you rights to them beyond using the app as intended.
Settings includes an explicit data-export action. Signed-in cloud exports require a recent sign-in and use a short-lived private download link; device-only users can export the data available locally. Exporting is separate from deleting an account and never authorizes deletion.
10. Availability and changes
We work to keep Dial Mom running but don't promise it will be uninterrupted, error-free, or available forever. We may add, change, remove, rename, replace, sell, or discontinue features or the service, subject to applicable law and the lifetime-access terms above. If we make a material change, we'll update the date and version above and, where appropriate, prompt you in the app. Continuing to use Dial Mom after a change means you accept the updated Terms.
11. Disclaimers and limitation of liability
Dial Mom is provided "as is," without warranties of any kind to the fullest extent allowed by law. We are not responsible for missed calls, forgotten birthdays, or relationships — the app is a reminder, and the follow-through is yours. To the extent permitted by law, our total liability for any claim relating to the app is limited to the amount you paid us in the 12 months before the claim (or, if you're on the free plan, USD $0). Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.
12. Termination
You may stop using Dial Mom at any time and delete your data. We may suspend or end access if you materially breach these Terms. Sections that by their nature should survive (ownership, disclaimers, liability limits) survive termination.
13. Governing law
These Terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the state and federal courts located there, except where local consumer-protection law gives you other rights.
